Stephen Breyer and the postfactual age

Linda Greehouse today:

....Justice Breyer’s belief in the power of facts, evidence and expertise was out of step in a postfactual age. The protections of the Voting Rights Act were no longer necessary in the South? The Constitution’s framers meant to give the populace an individual right to own a gun? Or, more recently, the federal agency charged with protecting American workers was likely powerless to protect the workplace from a deadly pandemic?

Really? Of course, Justice Breyer was on the losing side....

I’m not a liberal nor am I a fan of Breyer. But its totally pathetic how it was an all out secret assault on he man to force him out and then leak word of his retirement. They would have still had a chance to replace him had he retired on his own terms. Unless democrats can foresee themselves losing in 2024 n which case they have shown themselves to be extremist.

On the other hand, he was 84 years old. Regardless of why he retired---he doesn't seem like a guy who was easily bullied---President Biden would "replace" him. I suspect Breyer was just hoping for a Democrat in the White House before he retired. Not clear why you think liberals who urged him to retire are "extremist."
